Terms and conditions

This is an English translation of the Lithuanian original. In case of any discrepancy, the Lithuanian version prevails.

The terms and conditions set out in this document govern "1820", the car booking system that provides the services. This system belongs to MB "Autorasta", whose legal entity code is 304923372, and whose registered office is at Veiverių g. 9b-62, Vilnius, Lithuania.

The car booking service can be used in the following ways:

1. APPLICATION OF THE TERMS AND CONDITIONS AND DEFINITIONS

1.1. These Terms and Conditions may be unilaterally amended by 1820 where there are objective grounds for doing so, with the Customer being informed of any changes by a message sent through the 1820 app or by publishing information about the changes on the 1820 website (hereinafter – the Website).
1.2. Definitions:

  • • 1820 – the car booking system, the "1820" mobile app and MB "Autorasta", which operates the "1820" brand.
  • • 1820 service – the forwarding of the Customer's Order to the Carrier.
  • • Customer – a person who books a car through the "1820" system.
  • • Terms and Conditions – the document governing the use of the "1820" system.
  • • Order – a contract between the Carrier and the Customer concluded through the "1820" system, under which the Carrier undertakes to provide taxi or transportation services on the terms specified in the contract, and the Customer undertakes to pay for them.
  • • Carrier(s) – carriers providing private passenger transportation for remuneration or taxi carriers, booked through the "1820" app, operating in accordance with the laws and legislation of the Republic of Lithuania.
  • • Carrier's service – the transportation of the Customer by the Carrier for remuneration in a passenger car along a specific route.

2. USE OF THE 1820 MOBILE APP

2.1. The 1820 mobile app can be downloaded free of charge for "Android" and "Apple" mobile devices via "Google Play" and the "Apple App Store".
2.2. The information provided in this document is intended for Passengers who place Orders via the 1820 mobile app or via the website 1820.lt.

3. ORDERS BY CALLING +370 5 250 0500

3.1. Orders for the Carrier's service are accepted 24 hours a day, 7 days a week, by telephone on +370 5 250 0500 or 1820.
3.2. The telephone numbers +370 5 250 0500 and 1820 are intended solely for the acceptance of Orders. For all other matters, 1820 can be contacted using the contact details specified in point 12 of these Terms and Conditions.
3.3. When placing an Order by telephone, the Passenger must accurately specify the departure address A, as well as other important details (payment method, number of passengers, journey time, etc.). This helps the Carrier to properly fulfil the Order.

4. Orders online

4.1. The Carrier's service can be booked 24 hours a day, 7 days a week, on the website 1820.lt.
4.2. When completing the order form on the website 1820.lt, all required data must be entered and the necessary options selected. The Passenger must monitor on-screen notifications.
4.3. When booking the service online, you must provide your mobile phone number. If needed, we may call you, so please make sure the number is entered correctly.

5. BOOKING OF PASSENGER TRANSPORTATION AND CONTRACT WITH THE CARRIER

5.1. The Carrier and the Passenger agree on passenger transportation through a passenger transportation organiser. The passenger transportation contract between the Carrier and the Passenger is concluded using telecommunications equipment. The Carrier must provide the agreement information to road control authorities in accordance with the statutory rules.
5.2. The Passenger may place an Order for the Carrier's service using the methods specified in points 2–4.
5.3. The Order is deemed to have been placed when the Passenger specifies the exact departure location and presses "Confirm". Other information (payment method, notes, selection of Carriers, etc.) is merely supplementary, but the Passenger must still familiarise themselves with it.
5.4. By placing an Order, the Passenger confirms that all the data provided is correct.
5.5. After the Order has been placed, the Passenger receives the relevant information in the 1820 app or, if needed, by telephone. The Passenger may cancel the Order immediately. If they do not do so, the Order is deemed to have been placed and the Passenger is deemed to agree to the Terms and Conditions.
5.6. An Order placed by the Passenger and accepted by the Carrier is deemed to be a contract between the Passenger and the Carrier. The terms specified by 1820 are deemed to be the terms of the contract between the Passenger and the Carrier. Both parties are deemed to have agreed on the essential terms of the contract.

6. PASSENGER TRANSPORTATION SERVICES

6.1. Passenger transportation services are provided in accordance with the laws and legislation of the Republic of Lithuania and the service conduct standards. If Passengers notice violations of these standards, they must immediately inform 1820 thereof.
6.2. The tariffs for passenger transportation services may vary; Passengers are informed of any changes to them. The tariffs in force are available in the 1820 app.
6.3. In rare cases, the passenger carrier may cancel an already accepted Passenger's Order if there are important reasons for doing so. The Passenger is informed of this via the app or by telephone.
6.4. If there are doubts about the amount paid for passenger transportation services, the Passenger has the right to submit a written claim to the Carrier, which is responsible for providing the services in accordance with the tariffs. 1820 is not responsible for violations committed by Carriers. Upon receipt of a claim, the Carrier must respond no later than within one month. If no response is received within that period, the claim is deemed to have been rejected. The Passenger may also contact 1820 regarding such issues.
6.5. The Carrier must transport the Passenger to their desired destination by the most efficient route or according to the route specified by the Passenger. The Carrier may not voluntarily take on co-passengers. Co-passengers may only be taken at the Passenger's request.
6.6. The Carrier may transport Passengers only while holding a valid permit, as established and regulated by the legislation of the Republic of Lithuania.

7. LIABILITY OF 1820

7.1. 1820 is not responsible for the taxi, transport or logistics services provided by Carriers booked through the 1820 app, system or by telephone, as they are not employees of MB "Autorasta". Consequently, 1820 bears no liability for Carrier services that are improperly or poorly provided.
7.2. 1820 does not guarantee that the Carrier will accept the Order, and is not responsible for any adverse consequences that may arise from the services provided by the Carrier, including any possible consequences that may arise from the cancellation of the Order in accordance with point 3 of the Terms and Conditions.

8. RIGHTS AND LIABILITY OF PASSENGERS

8.1. After the journey, the Passenger may rate the Carrier's service in the "1820" app. This contributes to improving the quality of the Carrier's services.
8.2. The Passenger has the right to refuse the service if the Carrier arrived on time, but must then pay the minimum fee specified in the "1820" app and in the laws of the Republic of Lithuania. The following is prohibited in the Carrier's vehicle:

  • 8.2.1. Smoking, drinking alcohol, disturbing the atmosphere in the car, or damaging the car's equipment.
  • 8.2.2. Carrying flammable, explosive, toxic and odorous substances and other items capable of damaging or soiling the car, its seats or upholstery.
8.3. The Passenger is responsible for the correctness of the Order information provided (address, comments, etc.). Before placing an Order, the Passenger must check that the departure address is correct. If the mobile device determines the location incorrectly, the address must be entered manually.
8.4. The Passenger must follow the instructions received after the Order has been placed in the 1820 app or by telephone.
8.5. The Passenger is responsible for planning their own time. They must adequately assess the time it will take for the Carrier to arrive and transport them to the journey destination.
8.6. If the car is no longer needed, the Passenger must cancel the Order immediately.
8.7. The journey participant undertakes to respect the Carrier's time and to get into the Carrier's car and start the journey within the time provided by law from the moment the Carrier arrives at the departure address specified by the journey participant. The journey participant may be informed of this in the 1820 app or by telephone.
8.8. If a journey participant places and cancels a Carrier's Order three times in a row, 1820 has the right to temporarily restrict the provision of the service to that journey participant. A blocked journey participant may contact the 1820 administration by e-mail at taksi@1820.lt regarding unblocking.
8.9. The journey participant must pay the Carrier for the service provided in accordance with the tariffs in force.

9. PAYMENT FOR SERVICES, DISCOUNTS AND JOURNEY RECEIPTS

9.1. When booking the Carrier's service through the 1820 system, no additional charges apply (except for the Passenger's mobile and internet costs incurred during the Order). The journey in the booked car is charged according to the tariff in force at that time, applied by the specific Carrier.
9.2. The price of the journey is calculated according to the tariffs of the Carriers selected in the 1820 app. This is only an approximate price, calculated if the Passenger correctly specifies the departure and destination addresses. The final price of the journey may differ from the approximate price, depending on the route chosen, traffic conditions, delays, etc. The final price of the journey will be presented to the Passenger at the end of the journey.
9.3. The Passenger may pay for the Carrier's service in cash or by bank card. The preferred payment method must be specified before placing the Order.
9.4. The Carrier will provide the Passenger with the journey receipt immediately after the journey.
9.5. If the Passenger requests compensation for the journey through 1820, the journey receipt must be submitted.
9.6. If the Passenger has a discount or gift voucher and wishes to use it, the voucher code must be entered in the notes field, or 1820 must be informed by calling +370 5 250 0500, in order to use the discount or gift.
9.7. If the amount of the journey exceeds the value of the discount or gift voucher, the remainder must be paid to the Carrier in cash or by card. If there is any uncertainty regarding the terms of use of discount or gift codes, the 1820 administration should be contacted.

10. DATA SECURITY

10.1. By starting to use the 1820 system and completing the Order placement steps, the Customer grants 1820 permission to collect and store personal data.
10.2. The Customer has the right to withdraw their permission at any time. The withdrawal of permission does not affect the lawfulness of the data processing carried out on the basis of the permission prior to its withdrawal. The Customer also has the right to access their personal data and to demand the correction of incorrect, incomplete or inaccurate personal data. For all matters, the 1820 administration can be contacted by e-mail: taksi@1820.lt.
10.3. 1820 collects and processes only those personal data that users provide when installing and using the 1820 app or 1820.
10.4. Data controller: MB "Autorasta".
10.5. Data recipient: the relevant Carrier, to whom the Customer's address and telephone number are provided.
10.6. Personal data are collected only for defined and lawful purposes, as set out in point 10.9 of the Terms and Conditions, and are processed accurately and fairly and kept constantly up to date.
10.7. Data are used for direct marketing purposes only with the Customer's explicit consent; consent may be withdrawn at any time by writing to taksi@1820.lt.
10.8. Personal data are collected for the purposes of booking the Carrier, ensuring quality, determining the compliance of the Customer and the Carrier, and fulfilling the Order and other contractual obligations. Personal data are processed only for the purposes for which they were collected.
10.9. 1820 collects and stores the following passenger data: (i) where an Order is placed by the methods specified in points 3 and 4 of the Terms and Conditions, the telephone number and information relating to the Order (carrier, journey time and route); (ii) where an Order is placed by the method specified in point 2 of the Terms and Conditions, the first name, surname, telephone number, e-mail address, information relating to the Order (carrier, journey time and route), information about the mobile device (device model, operating system version), and GPS data (the passenger's geographical location during the use of the "1820" app and for 5 minutes after the journey).
10.10. Passenger data are provided only to the Carrier responsible for fulfilling the Order and only in order to achieve the purposes set out in point 10.8 of the Terms and Conditions. In this case, the passenger's telephone number and information about the Order (departure and destination addresses) are provided to the Carrier.
10.11. Data about Passengers are not transferred to third parties, except where this is required by competent state authorities on the basis of the relevant legislation of the Republic of Lithuania.
10.12. For quality assurance purposes, "1820" may record and store telephone conversations between the passenger, the carrier and the call centre when calls are made through the "1820" system. "1820" ensures the recording of telephone conversations and the storage of such data for 2 weeks. "1820" also collects and stores passengers' e-mail addresses and comments if the passenger has rated the carrier in the "1820" app after the journey.
10.13. If the passenger communicates directly with the carrier rather than through the 1820 system, the conversation is not recorded or stored.
10.14. All data presented in the 1820 app and system, including information about the carrier, are intended only for the specific passenger.
10.15. The Passenger can view their journey history in the 1820 app.

11. SEARCH FOR LOST ITEMS

11.1. The Passenger is responsible for their personal belongings during the journey with the Carrier. 1820 is not responsible for items left behind.
11.2. Items left in the car can be searched for by contacting the Carrier on +370 5 250 0500 or by using the 1820 app within 24 hours of the journey.
